General Terms and Conditions

Art. 1: Object of the Contract

1.1. These general conditions of sale are applied to the purchase of products made, advertised and marketed by the company "Zanchi Giovanni di Zanchi Maurizio & C Snc" (hereinafter "Products") through the e-commerce website www.zanchi1952.com (hereinafter "Site") by users falling within the definition of "Customers" pursuant to the following article.

1.2. The site, owned by Zanchi Giovanni di Zanchi Maurizio & C. Snc with registered office in Via Giuseppina, No. 60 46012 Bozzolo (MN) (hereinafter "Seller"), Fiscal Code and Company Register Registration Number 01994620209, VAT 01994620209 (below and simply "Zanchi Snc"). 

1.3. The Site deals with retail sales and as such is made for the exclusive use of Customers. Agents, wholesalers or, in any case, all those who intend to purchase the Products with the purpose of reselling them to third persons are not authorized to make purchases on this Site. In the case of the United Kingdom, only sales concluded after that publication.

1.4. Customers must be at least 18 years old to be able to make purchases on the Site and have legal capacity; the Customer, upon signing the order, declares compliance with these requirements.

1.5. Any communication by the Customer in relation to the purchase of the Products, including any communications, complaints, or requests regarding the purchase and/or delivery of the Products themselves or the exercise of the right of withdrawal, etc. - must be sent to the Seller, by registered letter a.r. or e-mail or pec, to the addresses published on the Site.

1.6. All purchases are governed by these General Terms and Conditions of Sale published on the Site at the time of the order submission by the Customer.

1.7. As per art. 13 of D.lgs. 70/2003, the Customer will receive by e-mail all the necessary details for the identification of the Seller, however, already indicated in the sales contract and in the order summary, as specified below. This documentation must be kept by the Customer.

1.8. The Seller reserves the right to modify all or part of these General Conditions of Sale at any time and at its discretion, without any obligation to give notice to users of the Site. It is specified that any changes will take effect from the date of publication on the Site and will apply only to sales concluded after such publication.


Art. 2: Purchase procedure

2.1. The Products are sold by the Seller with the characteristics described on the Site and in accordance with the General Conditions of Sale published on the Site at the time of order, as described in Art. 1 above, with the exclusion of any other term or condition. The main features of the Products are described in the individual product sheets on the Site. It is specified that the photographs illustrating the Products are outside this contractual framework and the specific characteristics described in the sheet but are simply illustrative and indicative. Consequently, the seller is not called to answer for any discrepancies and Zanchi Snc cannot be held responsible for any errors and/ or inaccuracies in the graphic and photographic reproductions on its website, because:

  • the representation of the product may differ depending on the internet browser and the monitor used by the customer.
  • each product is a craft creation and as such a single piece, each product can then differ slightly in shape, size and color than displayed on photographs or on the screen.

2.2. The presentation of the Products on the Site, which are not binding on the Seller, constitutes a mere invitation to the Customer to make a contractual purchase offer and does not constitute an offer to the public.

2.3. The purchase order submitted by the Customer to the Seller through the Site, on the other hand, constitutes a valid contractual offer and is subject to these General Conditions of Sale, which are an integral part thereof; by placing an order with the Seller, the Customer undertakes to accept the Seller in full without reservation.

2.4. The purchase order of the Customer shall be accepted by the Seller by sending an e-mail confirming the order to the Customer, to the address provided by the Customer to the Seller during the registration procedure on the Site, or during the order process if the Customer has not registered with the Site. The order confirmation e-mail sent by the seller must contain a summary of the order made, or indicate the order ID number, the detailed list of Products, their prices, the payment method chosen by the Customer, the delivery costs and the billing and shipping details provided by the Customer. The Customer’s order, the Seller’s order confirmation and the General Conditions of Sale applicable to the contract concluded between the Parties will be stored electronically by the Seller’s computer systems.

2.5. The Customer shall promptly verify the content of the communication and in any case shall be required to report immediately to the Seller, within 48 hours of receipt of the order confirmation e-mail, any errors, or omissions by contacting Zanchi Snc at 037691225 or by e-mail at care@zanchi1952.com

2.6. The contract for the purchase of the Products shall be deemed to have been concluded when the Customer receives the order confirmation from the Seller by e-mail.

Art. 3: Choice of products

3.1. The Products displayed in the e-commerce section of the Site can be purchased by the Customer by selecting the relevant Products and adding them to the virtual shopping cart. To purchase the Products chosen and placed in the cart, the Customer will have the opportunity to decide whether to register on the Site, providing the details required there or simply login (if the Customer is already registered) or provide your data so that the order can be completed, and the contract is concluded.

3.2. It is specified that registration on the Site is free of charge and allows the Customer to carry out, among others, the following operations: modify shipping and billing data, make purchases, consult the order history, track shipments, send notifications and delete account.

3.3. Where applicable, the promotional codes proposed on the Site will be valid only for the Products and for the period specified from time to time. Promotional codes are not refundable or cumulative with other offers. To take advantage of the promotions and/or special offers related to these codes, the Customer is required to enter the promotional code in the appropriate space indicated on the Site during the order confirmation. It is understood that it is not possible to cancel or modify an order to use a promotional code not entered by the Customer during the order confirmation.

Art. 4: Shipping and Delivery of products

4.1. The information contained on the Site about the availability or otherwise of the Products and their delivery times are purely indicative and in no case binding on the Seller.

4.2. The Seller undertakes to respect the delivery times as indicated on the Site. On average, the delivery time of the Products is approximately 45 (forty-five) calendar days from the day following that on which the Seller accepted the order. If the order cannot be processed by the Seller, as the Product ordered by the Customer is not available, even temporarily, for delivery, the Seller will give written notice to the Customer and refund any amount already paid by the Customer for the Product.

4.3. The Products ordered by the Customer will be delivered by express courier (national or international) to the delivery address as indicated by the Customer in the order request. To complete the correct delivery of the Products, the presence of the Customer, or of a subject appointed by him, at the destination address is required.

4.4. Zanchi Snc is responsible for the risk of loss and/or damage to the products purchased through the Site up to the time of delivery of the product to the final customer. The seller is not responsible for losses or damages that occur after this time.

4.5. The Customer undertakes to check promptly, or at the time of delivery of the Products by the courier/shipper, that the delivery has been carried out correctly and that it includes all and only the Products purchased and is required to promptly notify the Seller of the presence of any defective Products received and/ or any discrepancies and/ or discrepancies between the order and the goods received. Any such discrepancies must be immediately reported in writing directly at the bottom of the courier note. Once the courier’s waybill has been signed, the Customer will not be able to make any further claims regarding the external characteristics of the delivered goods. Art. 5: Purchase price and shipping costs or taxes

5.1. The price of the Products for sale is that indicated and described on the Site at the time of the order by the Customer. The prices of the Products indicated on the Site are inclusive of the costs for standard packaging, VAT (where applicable) and any indirect duties (where applicable). They are to be considered net of shipping costs, expenses that will be calculated and communicated in the order confirmation email sent by the Seller to the Customer and that the Customer undertakes to pay to the Seller in addition to the price indicated on the Site.

5.2 Depending on the country of destination of the Products to be delivered, the relative shipping costs will be displayed on the Site already during the order submission procedure; the Customer therefore acknowledges and undertakes to pay this cost in addition to the price of the Products ordered.

5.3. The total price to be paid to the Seller will then be indicated on the order confirmation sent by e-mail from the Seller to the Customer.

5.4. All additional costs, charges, taxes and/or duties payable in a particular country, in any way, to the Products ordered under the General Terms and Conditions of Sale are the sole responsibility and responsibility of the Customer.

5.5. Sales prices, Products sold on the Site and/or their characteristics are subject to change without notice. Such amendments shall apply only to orders after the date of entry into force of those amendments. In any case, the Customer is therefore advised to check the final prices before submitting the purchase order.

5.6. The Customer acknowledges that it accepts that the lack of knowledge of the costs, taxes and/or taxes referred to in paragraphs 5.4 and 5.5 above, at the time of sending the order to the Seller, does not constitute a fair cause for termination of this contract and that such costs may not in any way be chargeable to the Seller.

Art. 6: Procedure and methods of payment

6.1. Payments for orders placed on the Site may be paid by credit card in the manner and under the conditions described below. The Seller may also provide for other payment methods, which will be indicated on the Site.

6.2. If payments are made by credit card, the payment will be processed by Shopify Payments via Stripe Payments Europe Ltd. The data will be transferred securely and securely. This data remains inaccessible to the Seller.

6.3. In case of cancellation of the order or non-acceptance of the same by Zanchi Snc, the amount will be refunded exclusively through the payment method originally used by the Customer. It is specified that Zanchi Snc does not become aware of credit card information, nor does it manage an archive for the recording of such data. The Seller shall not store or store such data in any electronic file; Therefore, in no case can Zanchi Snc be held responsible for any improper or fraudulent use of the credit card by third parties as part of the payment of products purchased on the Site.

Art. 7: Conformity guarantee - Seller’s guarantee - complaint procedure

7.1. Pursuant to the provisions of European Directive 44/99/EC and Legislative Decree no. 206/2005 (Consumer Code), the Seller provides Customers with a legal guarantee that the Products purchased are free from material or manufacturing defects, and in accordance with the descriptions published on the Site.

7.2. The Customer is obliged to report any non-conformity no later than 8 (eight) days from the date of disclosure, under penalty of forfeiture from this warranty, and to inform the Seller by registered letter a.r. and/or pec and/or e-mail to the address: care@zanchi1952.com, at this location indicating the detected non-conformity and attaching the relevant supporting documentation (or at least 1 (one) photograph of the Product, the order confirmation sent by the Seller, copy of the courier’s delivery note).

7.3. Upon receipt of the communication, related to the relevant documentation, the Seller will assess the non-conformities reported by the Customer and will decide, at its discretion, whether to grant the authorization to return the/the Product/s/s itself, giving feedback to the Customer always by e-mail to the address provided by the Customer when registering with the Site or when placing the order. In any case, the authorization to return the Products does not imply in any case the recognition by the Seller of the non-conformity. In this case, the Seller will verify the non-conformity once the Products have been returned to the Seller. The Products of which the Seller has authorized the return must be sent by the Customer to the following address:

7.4. If the Seller is obliged to refund the Customer the price paid, the refund will be made using the same means of payment used by the Customer to purchase the Product.

Art. 8: Right of withdrawal

8.1. Without prejudice to the provisions, exceptions and cases of exclusion referred to in art. 59 of the Consumer Code, the Customer has the right to withdraw from the Contract concluded pursuant to these General Conditions of Sale, without incurring any penalty, within 14 (fourteen) days from the day on which the Product was delivered or if several Products of an order are delivered separately, from the date of receipt of the last Product.

8.2. To exercise the right of withdrawal, the Customer must communicate his decision to Zanchi Snc, within the period of 14 days as indicated in art. 8.1 above, by e-mail to: care@zanchi1952.com taking care to indicate in the subject of the communication "WITHDRAWAL" and specify the order number. The type of products and the data of the accompanying invoice.

8.3. After completing the requirements of paragraph 8.2 above, the Customer will receive an e-mail confirming the notice of withdrawal containing, if the product ordered has already been delivered and received by the Customer, the form (RMA) with all instructions on how to return the Product.

8.4. All Products must be returned to the Seller intact (without signs of wear, abrasion, scratches, scratches, deformation, etc.) complete with all parts and accessories, (packaging, boxes, documentation and/or other elements contained in the original packaging) otherwise the return will not be accepted. All shipping risks and direct costs incurred for the return of the products shall be borne by the Customer.

8.5. The Seller provides - as of now - that the return of the Products will be considered accepted only after having verified the integrity and the status of the returned Product. Verified this Zanchi Snc will proceed with to make the refund of the amount, giving prompt notice to the customer.

Art. 9: Protection of intellectual property rights, trademarks, and distinctive signs

9.1. The Customer acknowledges that all trademarks, names, and other distinctive signs as well as any names, images, photographs, written or graphic texts used on the Site or related to the Products are the exclusive property of Zanchi Snc and/or its successors, without any right to the Customer arising in relation to them because of access to the Site and/or purchase of the Products.

9.2. The reproduction, transfer and/or modification of - in whole or in part - the content of the Site is also prohibited.

Art. 10: Data Protection – Privacy

10.1. The Customer acknowledges and accepts that the personal data provided with the procedure of registration on the Site, the execution and the subscription of the order will be recorded and used by the Seller in accordance with and subject to the provisions of the Regulation (EU) 2016/679 on the General Data Protection Regulation ("GDPR"), to process any purchase made through the Site and, with your consent, as well as any other activity indicated in the Privacy Policy provided to the Customer through the Site at the time of registration.

10.2. The Customer declares and guarantees, under its personal responsibility, that the personal data provided to the Seller during the registration and purchase process are true and correct.

10.3. It is strictly forbidden for the Customer to enter false and/or non-existent data, and/or to use fictitious data in the registration procedure necessary for the performance of the contract, and it is also strictly prohibited to create more than one registration per person or use third-party data to perform the same. Zanchi Snc will have the right to report to the Competent Authorities and prosecute any violation or abuse, in the interest and protection of all Customers.

10.4. In the appropriate section "My Account" on the Site, the Customer may - at any time - update and/or rectify their personal data, as communicated to the Seller.

10.5. For any further information on how Customers' personal data is processed, please refer to the Privacy Policy section of the Site.

Art. 11: Security

11.1. Although the Seller takes all necessary precautions to protect personal data against loss, falsification, manipulation and misuse by illegal third parties, due to the characteristics and technical limitations relating to the protection of electronic communications via the Internet, the Seller does not guarantee that the information or data displayed by the Customer on the Site, even after the Customer has provided the relevant access credentials, they will not be accessible or viewable by unauthorized third parties.

11.2. The Seller is not responsible for any fraudulent or unlawful use that may be made by third parties, credit cards or other means of payment during the payment process of the Products purchased. At no time during the purchase procedure does Zanchi Snc become aware of or be able to access the Customer’s credit card number, which is sent via a secure connection directly to the bank service provider.

Art. 12: Default due to force majeure

12.1 The Seller shall not be held liable in the event of total or partial failure to comply with the obligations laid down in the contract concluded in accordance with these General Conditions of Sale, if such default is caused and/or is due to unforeseeable and/or natural events beyond its reasonable control, including, but not limited to, natural disasters, acts of terrorism, wars, riots, lack of electricity, general strike of public and/or private workers or strikes that restrict the operation of freight forwarders and air links and the like.

Art. 13: Disputes and applicable law

13.1. The sales contracts concluded between the Seller and the Customer governed by these General Conditions of Sale are governed and interpreted in accordance with current Italian legislation and the Consumer Code (D.lgs. 6 September 2005 n. 206), with specific reference to the law on distance contracts, and from Legislative Decree No. 70 of 9 April 2003, concerning all aspects of electronic commerce. Without prejudice to and without prejudice to the rights granted to Consumers by binding provisions in force in the Customer’s country of residence.

13.2. In the event of a dispute between the Seller and the Customer, the Seller shall endeavor to reach an amicable settlement with the Customers. For this purpose, Customers can directly contact the Conciliation Service of the Arbitration Chamber of Milan - as an agreement with the Chamber of Commerce of Mantua - also through the conciliation service On-line (cf. RisolviOnline service - Milan Chamber of Commerce). In this way the dispute will be resolved by a Sole Arbitrator, impartial and expert, for the achievement of a satisfactory agreement.

13.3. As an alternative to the conciliation referred to in art. 13.2 above, the Customer also has the right to access the European Online Dispute Resolution Platform (European ODR Platform) for the resolution of any disputes between the Seller and the Customer (cf. European Council Directive No. 2013/11/EU and Regulation (EU) No 524/2013), aimed at facilitating out-of-court solutions to national and cross-border disputes through the intervention of an ADR (Alternative Dispute Resolution) - cf. the following link: http://ec.europa.eu/odr.
